The Omnis Global Privacy Policy

This Omnis Global Privacy Policy applies to Omnis Holdings LLC; Omnis, Inc. and any other affiliated companies controlled by them worldwide. These companies are referred to collectively in this policy as "Omnis".

We Have the Utmost Regard for Your Privacy

Under no circumstances will Omnis sell your personal information.

In the usual course of providing development, advisory and training services to you, Omnis may obtain personal information about you. This is important to our ability to deliver the best possible services to you, but we understand that you expect us to treat this information in confidence and with care.

Our Global Privacy Policy describes the kind of personal information we may collect about you, the purposes for which we may use this information, the circumstances in which we may share the information and the steps that we employ to protect this information and preserve your privacy.

Types of Information We Obtain

The types of information we normally collect about you include:

Company and individual name, address and other contact coordinates;

Information about your business or government activities including principal specialties, mission statements, objectives, capabilities and other facts needed to evaluate and enhance our business relationship with you.

Your title, role and area of responsibility within your firm; and

Depending on the nature of the relationship and applicable anti-money laundering and other "know-your-customer" rules, we may be required to collect information such as photographic identification, passport facsimiles, driver's license, proof of residence, etc.

You are not required to supply any personal information we may request, although your failure to do so may result in our being unable to provide services to you.

How We Receive Personal Information

Information we collect about you comes primarily from correspondence, agreements, term sheets, product specifications, proposals or other forms and materials you deliver to Omnis during the course of our relationship. We also receive information about your transactions and experiences with Omnis relating to the services Omnis provides. Depending on the services you require, Omnis may obtain additional information about you as circumstances require.

In providing development and advisory services to you and subject to compliance with all applicable laws, rules and regulations, information may be collected about you indirectly from monitoring or other means such as recording of telephone calls and archiving of e-mails. This information may not be accessed on a routine basis, but may be preserved and used periodically for compliance or security purposes.

Our Use of Your Personal Information

Your personal information may be used by Omnis in order to:

Provide you with information or advice about products and services offered by Omnis;

Perform advisory, consulting, development, training and other services for you including potential joint development projects with you. The performance of these services may necessitate sharing your information internally with our staff and experts and occasionally providing it to third parties in strict accordance with the policies below;

Contact you or your agents by telephone, electronic mail, facsimile, etc., in connection with your relationship;

Meeting our security, legal and regulatory requirements.

In the event your business relationship with Omnis ends, we will continue to treat your personal information as described in this policy.

Disclosure Within Omnis of Your Personal Information

In the course of providing services to you, more than one entity within Omnis may be given access to, your personal information. This could happen in the case where one Omnis entity has specialized capabilities related to the services that another Omnis entity is providing to you; in that case, your personal information might be shared in order to evaluate the best possible solution to your service requirements.

Disclosures to Third Parties of Your Personal Information

Omnis does not disclose your personal information to third parties, except as described in this policy. Third party disclosures may include sharing such information with non-affiliated companies that support Omnis's operations generally such as law firms, accounting firms and information technology support services firms. Non-affiliated companies that support Omnis in providing services to you are required by Omnis to maintain the confidentiality of your information to the extent they receive it and to use your personal information only in the course of providing such services.

We may also disclose your personal information in situations where we request and receive your express permission. And your personal information may be disclosed to third parties as permitted by, or to comply with, applicable laws, rules and regulations and to cooperate with law enforcement or regulatory authorities.

Steps We Take to Protect Your Personal Information

Omnis devotes substantial resources to protecting the privacy of your personal information and considers this one of our most important duties. Only designated Omnis employees and agents will be given access to your personal information on a "need to know" basis and, as described above, our service providers are required by us to adhere to strict standards of privacy. Core features of our personal information security program are:

The use of physically remote secure access points;

The appointment of a dedicated Security Officer to supervise and test the implementation of privacy related systems;

The use of passwords, encryption and firewalls;

Continual evaluation of our systems infrastructure to uncover weaknesses and possible intrusions;

Periodic testing of the security of services before they are made available on the Internet, and ongoing surveillance and mitigation of known and potential weaknesses;

Continual training required of all Omnis employees responsible for the supervision, monitoring and utilization of our privacy protection systems.

Privacy and Omnis Websites

The following may be of interest to you if you access information about Omnis or utilize Omnis services through our Web sites:

Users of private Omnis Web sites may be required to identify and authenticate themselves prior to accessing our services. This generally takes place through the use of a User Name and Password, however, other security and encryption techniques may be used in certain instances.

Omnis Web sites are launched and operated upon a secure infrastructure with multiple layers of protection, including measures ranging from the physical security of our machines to system intrusion detection capabilities.

So-called, "cookies" are electronic text files of information stored by your Web browser. This information is used to enhance the speed and efficiency with which you can access our web sites by, for example, obviating multiple entry of certain identifying data. This information helps to verify your identity and provide similar "gate keeping" functions. You can set your Web browser to inform you when cookies are delivered, or to prevent cookies from being delivered.

Information regarding the Omnis Web pages you access, the frequency of such access and your service preferences may be shared internally within Omnis in order to assess your usage of and interest in our online services. If you are an Omnis client we may use such information to update you on Omnis services or to recommend services that may be of interest to you.

Effective Date and Changes to the Omnis Global Privacy Policy

This version of our Global Privacy Policy is effective as of July 27, 2008 and may be changed from time to time. Any such changes will be made available on our website with appropriate notification provided to indicate the nature and timing of such changes. Certain additional privacy policies may apply to specific transactions with you in which case your will be informed in writing and detailed statements of such additional policies will be provided to you.

You are entitled to access personal information about you in the possession of Omnis. You are also entitled to modify any such personal information that you believe is incomplete, incorrect or out of date.
